Just put the trap up on something the chipmunk can't climb. Should be metal, not wood - they can climb wood pretty good.

You could have also tried "aversion therapy" - dunk the trap in water, shake the trap around with him inside, make him afraid of the trap. Then let him go. Of course that won't affect his brothers and sisters....

Usually they can get out of a 1040 - must have been a pretty chunky chipmunk. LOL
