Your first paragraph could have come straight out of my own mouth. Horrible little creatures indeed. I leave my trap out, however I live in a forgiving neighborhood, with neighbors who mostly agree with the thinning squirrel population. For a while I had a section of New York gaming laws laminated and taped to my trap that basically said "Tampering or stealing of trapping equipment without authorization is against NewYork State law and can be penalized by fines up to $1,000"
I did for a while have a problem of somebody (identified by a neighbor driving a black car) who periodically released squirrels from my trap. This action stopped once I put the note on my trap. But I also have a lot of retieries in my neighborhood, so the chances of being spotted doing a dastardly deed are pretty high.
Leaving the trap out - although might promote squirrels to come investigate - it'll also give you a good chance to lower the ever-growing population. You need to assume for every squirrel you see - there is a potential for 4 more in 6 months. If you're not thinning them out - they'll disperse and find your house with or without a baited-trap in due time.
